How the result is built

    Only verified sources. Every statement in the result comes from an official document — the Maharashtra Co-operative Societies Act (as amended in 2019), the Registrar's extract of section 81, the 2014 Model Bye-laws, or the Maharashtra Apartment Ownership Act, 1970.

Limits of this tool

  • Maharashtra only, for now. Other states have their own co-operative laws, which this tool doesn't cover yet.
  • Laws and bye-laws change. The sources are dated; confirm the current position — especially deadlines — with your CA, auditor or lawyer.
  • Your society's own registered bye-laws decide most day-to-day matters. Model bye-laws apply only if your society adopted them.

What is the difference between a co-operative housing society and an apartment owners' association?

In a co-operative housing society, members hold shares in a society registered under the Maharashtra Co-operative Societies Act, 1960. In an apartment owners' association, each owner owns their apartment under a registered Declaration and Deed of Apartment under the Maharashtra Apartment Ownership Act, 1970, and the association is run by bye-laws annexed to the Declaration.

Are the Model Bye-laws compulsory?

They are a model issued by the Registrar. They govern a society once the society adopts them as its registered bye-laws. Check your registered copy. A revised draft was circulated in August 2026 and is not final.

Why is it Maharashtra only?

Who should I ask to confirm?

Your society's statutory auditor or CA for audit and accounts questions, and a lawyer for anything involving disputes, transfers or redevelopment.
